General
At Moment of Thanks, a national initiative providing an online service, available at www.MomentOfThanks.com ("MOT," "we", "our", "us" or "Website"), we recognize that privacy is important. This document (the "Privacy Policy") outlines the types of personal information we receive and collect when you use the Website and the MOT Services (as such term is defined in Moment of Thanks Terms of Service), as well as some of the steps we take to safeguard information. We hope this will help you make an informed decision about sharing personal information with us. By using or accessing MOT, you are accepting the practices described in this Privacy Policy and consenting to have your personal data transferred to and processed in the United States, whether you are a "Visitor" (which means that you simply browse the Website) or you are a "Member" (which means that you have registered with Website). The terms "User" and "you" refer to a Visitor or a Member.

MOT offers you the opportunity to create, post and share content that conveys messages and greetings to our troops. To enrich the experience of our Users, we request and display some personal information to other Users, which allows our Users to identify each other and expand their group of friends and contacts. Members can decide what information they wish to share by making decisions about what information to post and by changing their profile information at any time. They can also control how other Members and the service communicate with them.

Your California Privacy Rights
If you are a resident of the State of California, under the California Civil Code, you have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed personal information during the preceding year for direct marketing purposes. Alternatively, the law provides that if the company has a privacy policy that gives either an opt-out (which we may sometimes refer to as "unsubscribe") or opt-in choice for use of your personally identifying information by third parties (such as advertisers or affiliated companies) for marketing purposes, the company may instead provide you with information on how to exercise your disclosure choice options.

MOT qualifies for the alternative option; it has a comprehensive privacy policy and provides you with details on how you may either opt-out or opt-in to the use of your personal information by third parties for direct marketing purposes. Therefore, we are not required to maintain or disclose a list of the third parties that received your personal information for marketing purposes during the preceding year.

All requests sent via regular mail must be labeled "Your California Privacy Rights" on the envelope or post card and clearly stated on the actual request. For all requests, please include your name, street address, city, state, and zip code. (Your street address is optional if you wish to receive a response to your request via email. Please include your zip code for our own recordkeeping.) We will not accept requests via the telephone or by facsimile. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

Scope
This notice highlights the full Privacy Policy, which describes in detail the privacy practices that apply to the products, services, features and websites worldwide offer by MOT.

MOT follows two core principles:

You should have control over your personal information.
MOT helps you share content (such as videos, profiles, photos, comments, etc.) and information with your friends and people around you. You choose what content you post on the Website, what information you put in your profile, including contact and personal information, interests and groups you join. And you control the Users with whom you share that information through the privacy settings on the Website.

You should have access to the information others want to share.
There is an increasing amount of information available out there, and you may want to know what relates to you, your friends, and people around you. We want to help you easily get that information.

Sharing information should be easy and we want to provide you with the privacy tools necessary to control how and with whom you share that information. If you have questions or ideas, please send them to privacy@momentofthanks.com.

User Accounts
Users can access the Website and can view content without having a MOT account. Certain other activities on MOT, like uploading videos and photos, posting comments, or creating a group, require you to have a MOT account. We ask for some personal information when you create a MOT account, including your email address and a password, which is used to protect your account from unauthorized access. A MOT account allows you to access many of our services that require registration.

Your username (not your email address) is displayed to other Users in a variety of ways throughout the Website, and other Users can contact you through such means as private messages, groups and comments. Any videos, photos, comments and other content that you submit to MOT and/or post on the Website may be redistributed through the Internet and other media channels, and may be viewed by the general public.

You may, of course, decline to submit personally identifiable information through the Website, in which case you can still view certain videos, photos and other content while exploring the Website, but certain services and features may not be made available to you.

Children Under Age 13
MOT does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please DO NOT attempt to register for MOT or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on MOT. In the event that we learn that any personal information has been submitted to the Website from a child under age 13, we will delete that information as quickly as reasonably possible. If you believe that we might have any information from or about a child under 13, please contact us at privacy@momentofthanks.com.

Children Between the Ages of 13 and 18
We recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the Internet.

Information Collection and Use by MOT
MOT collects (i) User-submitted information on the Website such as name, email address, and age to authenticate Users and to send notifications to those Users, and (ii) other profile data including, but not limited to, personal interests, gender, age, and occupation in order to assist Users in finding and communicating with each other (collectively "Personal Information"). [We may disclose this Personal Information with MOT's affiliates, including, but not limited to, SheZoom, Inc. for marketing and administrative purposes and you will have the right to opt-out of such disclosure for marketing purposes.

MOT may also log non-personally-identifiable information including IP address, profile information, aggregate User data, and browser type, from Users of the Website. This data is used to manage the Website and the MOT Services, track usage and improve the services available on the Website. This non-personally-identifiable information may be shared with third parties to provide more relevant services and advertisements to Users. User IP addresses are recorded for security and monitoring purposes.

User profile information (such as gender and age) will be available to Users of MOT who choose to view such information and belong to at least one of the groups you allow to access the information through your privacy settings. User profile information may be displayed to people in order to facilitate User interaction in the MOT social community, also depending on your privacy settings. Email addresses may be used for such purposes as inviting new friends to join MOT, adding Users to Members' groups, sharing videos, photos, and other content, and sending notifications related to the services available on the Website. Users may communicate on MOT with each other through services made available on the Website without disclosing their email addresses. Members' full names are never directly revealed to other Members or Users.

We may also record information about your usage, such as when you use MOT, the channels, groups, and favorites you subscribe to, the contacts you communicate with, and the frequency and size of data transfers, as well as information you display or click on while interacting with MOT (including user interface elements, settings, and other information). If you are logged in, we may associate that information with your account. We may use clear GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to our Users to track which emails are opened by recipients.

We may also use a User's email address and other Personal Information to send updates, newsletters, other news regarding the Website and [offers for the purchase of other goods and/or services that may be of interest to Users.] Users may choose not to receive these mailings by changing their "notification" settings in the "Change Account Settings" section under My Account. MOT reserves the right to send you notices about your account even if you opt out of all voluntary email/regular mail notifications.

From time to time, MOT, a partner or affiliate may sponsor a promotion, sweepstake or contest on MOT. Users may be asked to provide Personal Information, including name, email address or home address or to answer questions in order to participate. If this information is to be shared with a third party other than MOT or its affiliates, this will made clear at the time of collection. If you do not want any of the foregoing information to be shared, you may always decline to participate in the promotion, sweepstakes or contest.

We may transfer Personal Information to certain ad partners that you have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the Personal Information and whose privacy statement will apply.] MOT may use information in your profile without identifying you as an individual to third parties. We do this for purposes such as aggregating how many people in a group like a video, photo or posting and personalizing advertisements and promotions so that we can provide the Website to you. We believe this benefits you. You can know more about the world around you and, where there are advertisements, they're more likely to be interesting to you. For example, if you put a favorite video or movie in your profile, we might serve you an advertisement highlighting a screening of a similar one in your town. But we don't tell the company who you are.

Content From Users
You submit your information and post User Submissions (as such term is defined in the Moment of Thanks Terms of Service) on the Website at your own risk. Although we allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Submissions and other information you post on the Website will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. You understand and acknowledge that, even after removal, copies of User Submissions may remain viewable in cached and archived pages or if other Users have copied or stored your User Content. Any personal information or video, photo or other content that you voluntarily disclose online (in groups, in comments, in messages, on channel pages, within your playback or profile pages, etc.) becomes publicly available and can be collected and used by others.

Any improper collection or misuse of information provided on MOT is a violation of the Moment of Thanks Terms of Service and should be reported to TOS@momentofthanks.com.

Invitations and Other Communications to Non-Members
Users on the Website can share videos and other content with friends and invite friends to join groups on the Website by sending emails from MOT. Except as set forth herein, MOT does not store or sell these email addresses or use them to send any other communication besides the designated content and invitations the Users sent.

Use of Cookies
MOT uses cookies to store Users' preferences and to record session information, for purposes including ensuring that Users are not repeatedly offered the same advertisements and to customize newsletter, advertising, and Web page content based on browser type and User profile information. We do not link the information we store in cookies to any personally identifiable information you submit while on the Website. You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set -- each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences -- however, you must enable cookies from MOT in order to use most functions on the Website. Please note that MOT may allow third party advertisers that are presenting advertisements on some of our pages to set and access their cookies on your computer. Advertisers' use of cookies is subject to their own privacy policies, not this Privacy Policy.

Profiles, Blogs, Comments and Groups
Please be aware that whenever you voluntarily post public information in profiles, on blogs, as comments or in any other public groups, that that information can be accessed by the public and may in turn be used by those people to send you unsolicited communications.

Correcting/Updating or Removing Information
MOT Users may modify or remove any of their personal information at any time by logging into their account and accessing features such as Changes to My Channel Page and Change Account Settings.

Mailing Choice/Opt-out
Members who no longer wish to receive updates and other notifications may choose not to by selecting 'Do not send me notifications' in the User profile "Account Settings". Users who do not wish to receive MOT newsletters or other notifications may choose not to by selecting 'Do not send me MOT newsletters' in the User profile "Account Settings". All notifications and MOT newsletters also include the above instructions for opting-out of those communications in the future.

Sharing Your Information with Third Parties
MOT is about sharing information with others - friends and people in your groups and others on the Website - while providing you with privacy settings that restrict other Users from accessing your information. We allow you to choose the information you provide to friends and groups through MOT. Our group architecture and your privacy settings allow you to make informed choices about who has access to your information. [We do not provide contact information to third party marketers without your permission.] We share your information with third parties only in limited circumstances where we believe such sharing is (i) reasonably necessary to offer the service, (ii) legally required or, (iii) permitted by you. For example:

  • We may provide information to service providers to help us bring you the services we offer. Specifically, we may use third parties to facilitate our business, such as to host the service at a co-location facility for servers, to send out email updates about MOT, to remove repetitive information from our User lists, to process payments for products or services, to offer an online job application process, or to provide search results or links (including sponsored links). In connection with these offerings and business operations, our service providers may have access to your personal information for use for a limited time in connection with these business activities. Where we utilize third parties for the processing of any personal information, we implement reasonable contractual and technical protections limiting the use of that information to the MOT-specified purposes.
  • We may be required to disclose User information pursuant to lawful requests or legal requirements, such as subpoenas, search warrants or court orders received by MOT, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the MOT service or using the MOT name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.
  • We may disclose personal information to a third party in order to enforce the Moment of Thanks Terms of Service or to protect our rights.
  • We may disclose personal information to a third party in order to protect the safety of members of the public and Users of the MOT Services.
  • We let you choose to share information with marketers or electronic commerce providers through sponsored groups or other on-site offers.
  • We may offer stores or provide services jointly with other companies on MOT. You can tell when another company is involved in any store or service provided on MOT, and we may share customer information with that company in connection with your use of that store or service.

If the ownership of all or substantially all of the MOT business, or individual business units owned by MOT, were to change, your User information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your User information would remain subject to the promises made in any pre-existing Privacy Policy.

Links
MOT may contain links to other websites. We are of course not responsible for the privacy practices of other web sites. We encourage our Users to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by MOT.

Third Party Advertising
MOT or one of our advertising partners may deliver ads appearing on the Website to Users. Our advertising partners may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad group to deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by MOT and does not cover the use of cookies by any advertisers.

Security
Member accounts are secured by Member-created passwords. MOT takes precautions to insure that Member account information is kept private. We use reasonable measures to protect Member information that is stored within our database, and we restrict access to Member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Please note that we cannot guarantee the security of Member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of Member information at any time. Changes in Our Privacy Policy
From time to time we may make changes to this Privacy Policy. If we make changes, we will post them on the Website to make Users aware of what the changes are so Users will always be aware of what information we collect, how we use it, and when we may disclose it. A User is bound by any minor changes to the policy when she or he uses the Website after those changes have been posted. If, however, we are going to use Users' personally identifiable information in a manner materially different from that stated at the time of collection, we will notify Users by posting a notice on the Website thirty (30) days prior to making any such material change.
